Professor Yoram Dinstein, international law Professor Emeritus at Tel Aviv University, spoke at the conference "Hamas, the Gaza War, and Accountability under International Law," hosted by the Jerusalem Center for Public Affairs on June 18, 2009. Professor Dinstein spoke about the issue of terrorism in international law. How does international law define a terrorist organization? One who perpetrates acts that cause the death or damage to civilians who do not participate in hostile events in order to intimidate a civilian population or cause the government to change its policies. Countries, though, differentiate between terrorists. One country cares more about the terrorists that are trying to harm its own population than a similar scenario in a different country. After the terrorist acts on 9/11, the international community says that a country is allowed to fight against a non-state actor. Who is defined as a combatant? Civilians according to international law are those who don't take "direct part" in combat. If someone is in the process of committing a terror act and is caught, he is directly connected. This becomes complicated, though, because Hamas does not dress in uniform and hides among civilian populations. Many argue that the international community needs to find new paradigms to set international law. Transcript AMY GOODMAN: The United Nations is poised to send an additional 3000 troops to the eastern part of the Democratic Republic of Congo, where reports of rape, looting and murders of civilians by both government and rebel forces continue to rise. A quarter of a million people have been displaced since rebel forces led by General Laurent Nkunda advanced towards the provincial capital of Goma this August. The United Nations has accused both the Congolese army and Nkunda's forces of committing war crimes during the latest violence. Goma is now ringed with refugee camps, but rebel leaders ordered displaced people staying near the United Nations peacekeeping compound to return to their homes. Many are scared of going back. MAMY CHIBALONZA: [translated] We are afraid to go back, because they rape women, and they rob us, too. They rape women of all ages. DISPLACED CONGOLESE WOMAN: [translated] The new occupants told us to go home, and if we don't go home, they will shoot at us.
